  5. Your personal data will not be transferred to third countries, that is countries outside the European Economic Area.
  6. Your personal data will be processed until withdrawal of consent.
  7. You have the right to access your data and the right to rectify, delete, limit processing and revoke consent at any time.
  8. Providing data is voluntary.

Clause for persons requesting the execution of their rights under the RODO

    • The data subject’s right of access;
    • The right to rectification of the data;
    • The right to erasure (“right to be forgotten”);
    • The right to restrict processing;
    • The right to data portability;
    • Right to object in accordance with Article 6(1)(c) of the RODO;
    • in order to assert and defend against claims (Article 6.1.f RODO).
  4. Your personal data may be forwarded to Poczta Polska S.A., companies providing legal assistance, e-mail hosts, software providers, IT support companies and other entities authorized by law.
  5. Your personal data will not be transferred to third countries.
  6. Your personal data will be processed for 5 years.
  7. You have the right to access your data and the right to correct, delete, limit processing.
  8. Your personal data is required by law, and their failure will prevent the implementation of your rights.

Clause for the patient performing the COVID-19 test

According to Article 13 (1) and (2) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, we inform you that:

  3. Your personal data will be processed in order to
    a) performance of laboratory tests for COVID-19 infection and the maintenance and storage of medical records on the basis of the premise of Article 6(1)(c) of RODO in conjunction with Article 9(2)(h) of RODO, i.e. to fulfil legal obligations incumbent on the controller in connection with the Act on Health Care Activities and the Act on Patient Rights and Patient Ombudsman.
    b) performance of a contract based on the premise of Article 6(1)(b) of the DPA.
    c) financial and accounting settlements based on the premise of Article 6(1)(c) of RODO, i.e. performance of the legal obligation imposed on the controller in connection with accounting regulations.
  4. Your personal data will be forwarded to Silesian Medical Technology Park Kardio-Med Silesia Sp. z o.o., e-mail host, software providers, banks, IT support companies, a company providing HR and accounting services and other entities authorized by law.
  5. Your personal data will not be transferred to third countries.
  6. Your personal data will be processed for the following periods:
    a) medical records – for the period specified in the provisions of the Act on Patient Rights and Patient Ombudsman
  7. b) financial and accounting records for the period specified in the law on accounting – i.e. 5 years from the end of the calendar year in which the tax deadline expired.

  8. You have the right to access your data and the right to rectify, delete, limit processing, the right to data portability.
  9. Your data is necessary to perform the contract. Failure to provide such data will make it impossible to perform the test.
  10. You have the right to lodge a complaint to the President of the Data Protection Office (ul. Stawki 2, 00-193 Warsaw, POLAND), if you believe that the processing of your personal data violates the law.
  11. Your data will not be subject to profiling and automated decisions will not be made on their basis.

Clause for the contractor and natural persons acting as members of bodies of legal persons, proxies, attorneys, representatives of contractors and contact persons on the part of the contractor

In accordance with Article 13 (1) and (2) and Article 14 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, we inform you that:

  3. In a situation where you are a representative of our Contractor your personal data
    1) will be processed in order to:

    • establishing and maintaining business relations, including signing contracts or for the purpose of contact in connection with contract performance on the basis of the legally justified interest of the administrator -art. 6(1)(f) RODO;
    • performing legal obligations of the controller, e.g. related to financial and accounting settlements – on the basis of art. 6 section 1 letter c RODO;
    • asserting claims on the basis of the Company’s legitimate interest – Article 6(1)(f) of RODO;

    2) We obtained your data:

    • If you are a person representing the company – from the entity in which you serve as a member of the bodies of legal persons and from registers of business entities (KRS, CEIDG, GUS), publicly available sources – including the website of the entity which you represent
    • In case you are a person appointed by the entity to contact: from the entity in which you perform this function under the contract.

    3) Your data will not be subject to profiling and automated decisions will not be made on their basis.

  4. In a situation where you are our contractor, – a party to the contract between us, your personal data
    a) will be processed in order to:

    • performance of the contract and taking action at the request of the data subject prior to the conclusion of the contract in accordance with the premise of Article 6(1)(b) RODO;
    • to comply with legal obligations imposed on the controller, e.g. related to financial and accounting settlements, on the basis of Article 6(1)(c) of the RODO
    • maintaining business relations on the basis of a legitimate interest of the controller – Article 6(1)(f) of RODO;
    • pursuing claims on the basis of the Company’s legitimate interest – Article 6(1)(f) of the RODO;

    b) Your data was obtained from publicly available sources – the Internet (registers of economic entities, such as CEIDG, KRS, GUS, websites). Furthermore, providing your personal data is necessary to conclude and perform the contract.

    c) Your data will not be subject to profiling and automated decisions will not be made on their basis.

  5. Your personal data will be forwarded to Poczta Polska S.A., an e-mail host, IT support companies, banks, the Tax Office and other entities if required by law.
  6. Your personal data will not be transferred to third countries.
  7. Your personal data will be processed for a period
    • in a situation where no contract is concluded – until the end of negotiations, but no longer than a year from the last contact.
    • If a contract is concluded – for the time of its execution, and then until the expiry of claims under the contract.

    Data from financial documents will be stored for the time specified in the law on accounting – i.e. 5 years, counting from the end of the calendar year in which the deadline for tax payment expired.

    Data processed on the basis of legitimate interest will be processed until you file an objection, but no longer than necessary to achieve the indicated purpose.

  8. You have the right to access your data and the right to rectify, erase, limit processing, the right to data portability and object.
  9. You have the right to lodge a complaint to the President of the Data Protection Office (ul. Stawki 2, 00-193 Warsaw, POLAND), if you believe that the processing of your personal data violates the law.

Clause for job applicants

On the basis of Article 13 (1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016. (hereinafter: RODO) we inform you that:

  3. Your personal data will be processed in order to conduct the recruitment process
    • under the provisions of the Labour Code and your consent – Article 6(1)(c) and (a) of the RODO – for employment contracts
    • on the basis of the provisions of the Civil Code and your consent – Article 6(1)(b) and (a) for civil law contracts.

    Your personal data may be processed for the purpose of future recruitment in case you express your separate consent to such processing pursuant to Article 6(1)(a) of RODO.

    Your data may be processed in order to assert and defend against claims based on the premise of the controller’s legitimate interest – Article 6(1)(f) RODO.

  4. Your personal data will be forwarded to recruitment portals, e-mail hosts, IT support companies, Poczta Polska S.A. and other entities, if required by law.
  5. Your personal data will not be transferred to third countries.
  6. Your personal data will be processed until the end of the recruitment process or the expiry of claims. In the case of consent for future recruitment, your data will be processed until the revocation of consent, but no longer than 6 months.
  7. You have the right to access your data and the right to rectify, erase, limit processing, the right to data portability, revoke consent at any time, without affecting the legality of the processing, which was performed on the basis of consent before its withdrawal, and to object.
  8. Providing personal data is voluntary, but their failure to prevent participation in the recruitment process.
  9. You have the right to lodge a complaint to the President of the Data Protection Office (ul. Stawki 2, 00-193 Warsaw, POLAND), if you believe that the processing of your personal data violates the law.
